1. Agreement to Terms

By downloading, installing, or using Calmony ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Calmony ("we", "our", or "us").

2. Description of Service

Calmony is a desktop calendar application that:

• Integrates multiple calendar accounts (Google Calendar, Apple iCloud, Microsoft Exchange)
• Provides unified calendar view and management
• Supports natural language event creation
• Offers premium features through subscription or one-time purchase

3. Eligibility

To use Calmony, you must:

• Be at least 13 years of age (or the minimum age in your jurisdiction)
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the App under applicable laws

4. Account and Third-Party Services

4.1 Calendar Accounts

To use core features, you must connect at least one calendar account. By connecting your accounts, you:

• Authorize Calmony to access your calendar data
• Agree to the terms of service of your calendar provider
• Acknowledge that your calendar data remains governed by your provider's policies

4.2 Your Responsibilities

You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur through your connected accounts
• Ensuring your use complies with your calendar provider's terms

5. Subscriptions and Purchases

5.1 Subscription Plans

5.2 Billing and Renewal

• All purchases are processed through the Apple App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your App Store account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

5.3 Price Changes

We reserve the right to change subscription prices. Price changes will:

• Be communicated in advance
• Not affect your current billing period
• Apply to subsequent renewal periods

5.4 Refunds

Refund requests are handled by Apple according to their refund policy. To request a refund:

1. Visit reportaproblem.apple.com
2. Sign in with your Apple ID
3. Select the purchase and request a refund

We do not have direct access to process refunds.

6. Lifetime License Terms

6.1 Scope

The Lifetime License provides:

• Permanent access to all features available in version 1.x
• No recurring charges
• Access on devices signed into your Apple ID

6.2 Limitations

The Lifetime License does NOT include:

• Major version upgrades (v2.0 and beyond) unless explicitly stated
• Priority customer support (subscription benefit only)
• Guaranteed feature parity with future subscription plans

6.3 Non-Transferable

The Lifetime License is:

• Tied to your Apple ID
• Non-transferable to other accounts
• Non-refundable except as required by applicable law

7. Acceptable Use

7.1 You Agree NOT To:

• Use the App for any illegal purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent any security features or access restrictions
• Use automated systems to access the App in a manner that exceeds reasonable use
• Interfere with or disrupt the App's functionality
• Violate the terms of your calendar service providers

7.2 Content Responsibility

You are solely responsible for:

• The calendar events and data you create
• Ensuring your content does not violate any laws or third-party rights
• Backing up your important data

8. Intellectual Property

8.1 Our Rights

Calmony, including its design, features, and content, is protected by copyright, trademark, and other intellectual property laws. We retain all rights not expressly granted in these Terms.

8.2 Your Rights

You retain ownership of your calendar data. By using the App, you grant us a limited license to access and display your data solely for providing the service.

8.3 Feedback

Any feedback, suggestions, or ideas you provide may be used by us without obligation to you.

9. Privacy

Your use of Calmony is also governed by our Privacy Policy. By using the App, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers

10.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF DATA

10.2 Third-Party Services

We are not responsible for:

• The availability or accuracy of third-party calendar services
• Changes to third-party APIs that may affect functionality
• Data loss caused by third-party service failures

10.3 No Guarantee

We do not guarantee that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components

11. Limitation of Liability

11.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Cost of substitute services

11.2 Maximum Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

11.3 Essential Purpose

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

13. Termination

13.1 By You

You may stop using the App at any time by:

• Uninstalling the App
• Cancelling your subscription (if applicable)

13.2 By Us

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the service

13.3 Effect of Termination

Upon termination:

• Your right to use the App ceases
• Provisions that should survive termination will remain in effect
• We are not obligated to retain your data

14. Changes to Terms

We may modify these Terms at any time. Changes will be effective when posted. Continued use after changes constitutes acceptance of the new Terms.

For material changes, we will:

• Update the "Last Updated" date
• Provide notice within the App

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes shall be resolved through:

1. Good faith negotiation
2. Mediation (if negotiation fails)
3. Binding arbitration or court proceedings in Seoul, Korea

15.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions.

16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us.

16.2 Severability

If any provision is found unenforceable, the remaining provisions will continue in effect.

16.3 Waiver

Our failure to enforce any right does not constitute a waiver of that right.

16.4 Assignment

We may assign our rights under these Terms. You may not assign your rights without our consent.

18. Apple-Specific Terms

As required by Apple:

1. These Terms are between you and Calmony, not Apple
2. Apple has no obligation to provide maintenance or support
3. Apple is not responsible for product warranties
4. Apple is not responsible for any claims related to the App
5. Apple is a third-party beneficiary of these Terms

By using Calmony, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
